High court rules in favour of Canadian cable and satellite TV broadcasters

There will be no retransmission fees for local TV signals following a ruling today in the high court which is good news for Canadian cable and satellite TV operators.

In a 5-to-4 decision, the high court ruled that the CRTC has no jurisdiction to place a value for signal fee on the local broadcasters.

The provisions of the Broadcasting Act, considered in their entire context, may not be interpreted as authorizing the CRTC to implement the proposed value for signal regime,” Supreme Court justices McLachlin, LeBel, Fish, Rothstein andMoldaver said.

The ruling overrides the previous Federal Court of Appeal ruling.
